INFORMATION REGARDING THE PROCESSING OF PERSONAL DATA PURSUANT TO ART. 13 OF REGULATION (EU) 2016/679 ("GDPR")

1. DATA CONTROLLER

K-Digitale srl, registered office in via G.B.Pontani 39 Perugia - Italy,  acts as Data Controller and can be contacted via e-mail at fp.privacy@k-digitale.com. 

2. DEFINITION OF PERSONAL DATA AND INFORMATION RELATING TO THE THEIR PROCESSING 

For the purposes of the GDPR, personal data means: “Any information concerning an identified or identifiable natural person; The natural person who can be identified, directly or indirectly, with particular reference to an identifier such as name, identification number, location data, an online identifier or one or more Elements characteristic of its physical, physiological, genetic, psychic, economic, cultural or social identity "(the" Data").

The following Policy only concerns the processing of personal data of users / visitors that:

• Ask for information via the contact forms on the site
• register for e-commerce

This policy does NOT relate to the processing of personal data relating to economic transactions resulting from online purchases, made from the site www.k-digitale.com , which are regulated directly by the sites responsible for managing the transactions themselves, currently via PayPal.

For the treatments covered by this information, the following types of personal data of the interested parties are processed (users - visitors to the website of www.k-digitale.com) 

BROWSING DATA COLLECTED IN AN AUTOMATED MANNER
While browsing, the following User information may be collected and stored in the log files of the server (hosting) of the Site:

3. PURPOSE OF PROCESSING
The navigation data is collected and processed to carry out any activity concerning the management and administration of the Website, including the management of IT security. The data could also be used to obtain anonymous statistical information on the use of the site and to check its correct functioning.

 - The legal basis of these processing is the legitimate interest of the Data Controller.

Personal data provided voluntarily by users can be collected and processed for the following purposes:
a) to respond to explicit requests from the interested party
b) to take charge and manage the registration of interested parties in the e-commerce section of the site
c) to manage the account created by the interested parties following the registration
d) to manage the contract
e) to manage the functional, instrumental and / or complementary activities related to the contract
f)  to manage the administrative, accounting and tax obligations, as well as legal obligations of a civil nature envisaged by the Owner and consequent to the sale contract concluded
g) to manage the performance of activities aimed at improving business processes, in order to ensure higher standards of quality and effectiveness of the services offered

- For the pursuit of the purposes referred to in letters a) to d) the legal basis of the processing is to be recognized in the execution of a contract of which the interested party is a party, or the execution of pre-contractual measures adopted at the request of the same.
- For the pursuit of the purpose referred to in letter f) in the fulfillment of legal obligations to which the Owner is subject.
- For the pursuit of the purposes referred to in letter g) in the legitimate interest of the Owner.

 

4. METHOD OF TREATMENTS AND CONFIDENTIALITY OBLIGATION
The data processing is performed through IT tools and / or paper supports, by subjects committed to guaranteeing the confidentiality of the treatments and authorized by the Data Controller, with logic related to the purposes and in any case in such a way to guarantee the security and confidentiality of the data. The collected data will, in no way, be disclosed to indeterminate subjects.

 

5. COMMUNICATION OF DATA TO SUBJECTS LOCATED IN THE EU
K-Digitale s.r.l. may communicate some user data to authorized subjects located in the EU which it uses for the performance of activities related to the management of the services provided.
In particular, in order to achieve the purposes described in the previous article 3, as an integral part of the processing activities, the Data may be disclosed to external companies that offer K-Digitale srl IT services, and / or external consultants who will process the Data as Data Processors.

Furthermore, the Data Controller may communicate the Data to subjects to whom the communication is due by virtue of legal obligations.

 

DATA RETENTION PERIOD
The personal data acquired will be stored by K-Digitale srl as following:

• With specific regard to the data processed for the purposes of administration and management of the website, users' browsing data will be kept for 3 days.
• With the specific regard to the data processed for the management of e-commerce, the data will be processed for a period of 24 months following registration in the e-commerce section in case of non-purchase or, in case of purchase, from the conclusion of the last purchase agreement.
• With the specific regard to the data processed for the pursuit of the purposes referred to in letter f) of the previous art. 3, for a period of 10 years following the issue of the sales invoice.
• For a period not exceeding 26 months, in the case of processing for anonymous statistical analysis on the use of the site.
• In the case of legal disputes, the data will be kept for the entire duration of the same, until the deadlines for appeals are exhausted. Once the retention terms indicated above have elapsed, the Data will be destroyed, deleted or made anonymous, compatibly with the technical cancellation and backup procedures.

 

6. RIGHTS OF THE INTERESTED PARTIES
Pursuant to European Regulation 679/2016 (GDPR), the User can, according to the methods and within the limits established by current legislation, exercise the following rights: 

• Right of access – the right to obtain confirmation of the existence or otherwise of a treatment concerning personal data as well as the right to receive any information relating to the same treatment; if K-Digitale refuses to satisfy the access requests, the reasons for the relative refusal will be provided.
• Right to rectification – the right to obtain the rectification of the data held by K-Digitale, if they are incomplete or incorrect.
• Right to cancellation - in certain circumstances, the rght to obtain the cancellation of the data present in the K-Digitale’s archives;
• Right to limitation of processing, upon the occurrence of certain conditions, the right to obtain limitation of data processing;
• Right to data portability – the right to obtain the transfer of data held by K-Digitale to another Data Controller;
• Right to object- the right to object to the processing of data;
• Right to lodge a complaint with the Supervisory Authority – If applicable, the right to lodge a complaint as described in the following paragraph 7;
• Right to withdraw consent given.
